Staff recommends that the City Council introduce for first reading an Ordinance amending Santa Monica Municipal Code (SMMC) Chapter 4.44 (Regulation of Smoking) to include the prohibition of smoking in parklets.

Executive Summary

On November 24, 2015, (Attachment B) Council authorized the parklets pilot program on Main Street for the duration of one year. Parklets are being created from the conversion of two on-street parking spaces and will function as public space.  Smoking is already prohibited in a variety of public spaces in the City, including the Third Street Promenade, Santa Monica Pier, any outdoor service or dining areas, and any public park. The proposed amendment to the municipal code would add parklets to the list of public locations where smoking is prohibited.

 

Background

The Parklet Pilot Program is part of the City of Santa Monica’s overall vision, as outlined in the Land Use and Circulation Element (LUCE) for creating pedestrian friendly routes and pedestrian amenities. The LUCE reorients the City’s auto-oriented boulevards into inviting avenues with wider sidewalks, improved transit, distinctive architecture, landscaping, trees and planted medians, and neighborhood-friendly services; these changes will define a new sense of place that will attract local residents to shop, work, live, and play.  Parklets are sidewalk extensions that provide more space and amenities for public use of the street.  The Main Street parklets would be created from the conversion of two on-street parking spaces and would extend out and be at the same grade as the sidewalk.  The parklets would be made of wood platforms and include a built-in standing counter, built-in seating, planter boxes, railings, bike parking, and other features necessary to traffic safety. 

 

On November 24, 2015, Council selected three businesses on Main Street to operate/maintain parklets including:

·              Finn McCool’s at 2702 Main Street;

·              Ashland Hill at 2807 Main Street; and

·              Holy Guacamole at 2906 Main Street.

The City is designing and building the parklets and the operators are providing furniture and will maintain the parklets pursuant to the terms of a license and maintenance agreement. The following is the tentative implementation schedule:

Discussion

SMMC Section 4.44.020(a) prohibits smoking in specific public locations in the City including, but not limited to public parks, public beaches, outdoor dining areas, and the Third Street Promenade. Parklets are a similar public space where it is anticipated people will gather, eat, drink, and spend a portion of their day. Staff recommends an amendment to the smoking ordinance that similarly prohibits smoking in parklets.  Parklet operators have been informed of this ordinance amendment in the course of meetings with staff. 

 

Financial Impacts and Budget Actions

There is no immediate financial impact or budget action necessary as a result of this recommended action. Staff will return to Council if specific budget actions are required in the future.
